Pre-complaint intervention allows for resolving cases without a formal complaint, aiming to expedite resolutions and reduce legal processes.

  • Pre-complaint intervention occurs when it is deemed a time-sensitive issue can be resolved without formal legal filings.
  • It often involves an agreement for the respondent to change a policy or provide an accommodation.
  • This approach avoids the more extensive legal procedures of filing a formal complaint and aiming for settlement or court processes.
  • The discussion also touches on the percentage of cases ineligible or resolved through pre-complaint intervention versus those affected by staffing issues.

And then I guess a follow-up to that follow-up is the pre complaint intervention is essentially like when you settle or have some type of resolution without having to, like, take any further serious legal action.
1:06:32
Correct?
JoAnn Kamuf Ward
1:06:33
Yeah.
1:06:33
So it's where we don't go through typically, if someone comes to us and they have viable claim.
1:06:40
They work with a CCHR attorney to fashion legal complaint just like you would see in court that's filed with our agency and that's the basis for the investigation and further discussions hopefully settlement, but sometimes going to oath.
1:06:54
In the pre complaint intervention space, someone comes to us.
1:06:57
It is off the bat.
1:06:59
We can tell it's a time sensitive issue that you know, because maybe they're they they have already a relationship with the respondent.
1:07:06
We might be able to track down the respondent and get something done.
1:07:09
That so that means there's no there's no formal complaint as ever filed.
1:07:12
So it does away with a lot of the the legal process and seeks to resolve a a claim just with an agreement for the respondent to either change a policy, give a person accommodation, or or something of that nature.

And Maggie filed as those cases get filed as pre complaint intervention.
1:07:31
And so it would be helpful to know, like, what percentage also of, like, the 12 1000 is, like, ineligible or pre complaint intervention.
1:07:38
So I think that the narrative, as you know, is that you have all of these cases and you struggle to close the cases because of staffing issues.
1:07:46
So just wanted to, like, understand what that really looks like in detail fashion.
1:07:50
Like, how many of these cases are you actually unable to close?
1:07:54
Or truly filed because of a a staffing issue versus what cases are simply handled without a formal complaint.
1:08:02
What cases are technically ineligible so you can't even take any real action on them.
JoAnn Kamuf Ward
1:08:07
Yeah.
1:08:08
And this this is all in, like, our MMR.
1:08:10
I just wanna be able to give like, life to the to the narrative of the numbers, and I think the way to do that justice is to talk through specific protective categories.

Thank you.
