Deputy Commissioner Laura Popa provides information on expected compliance rates for Local Law 97 and discusses the challenges in predicting compliance for different types of buildings. She explains the timeline for when more detailed compliance information will be available.

  • An 89% compliance rate is expected for non-affordable housing buildings that need to reduce emissions
  • For other buildings, compliance is harder to predict due to various compliance options available
  • More detailed compliance information will not be available until after May 1, 2025, when buildings submit their reports

I just next wanted to ask and then I promised you, I'll shut up, is it's expected.
3:26:23
I don't know.
3:26:23
90% of the buildings that are subject to 2020 or going to be in compliance with the 24 to 29 limits.
Laura Popa
3:26:31
Those are 320 buildings.
3:26:33
So it's expected that for those, right, the ones have to have to reduce their emissions, the non affordable housing buildings, that there's about an 89% compliance rate.
Lincoln Restler
3:26:42
Okay.
Laura Popa
3:26:42
And then we all so have 10,003,21 buildings who need to comply on top of that.
3:26:48
It's very difficult to judge their compliance, but we do know that about 22,000 something and maybe so close to 3000 or mid 2000 already meet the 2030 emissions limit.
3:27:00
So they comply out of the 10,000.
3:27:03
To know how the others are going to comply, we cannot know in advance.
3:27:07
There's no way to judge because they don't have to reduce their emissions.
3:27:09
They can do the prescriptive energy conservation measures.
Lincoln Restler
3:27:12
So are you expecting so do we have any indications at this point of how many buildings are taking advantage of the new rules that allow them to apply for extensions.
3:27:24
Have those extensions been submitted to you all as of yet?
Laura Popa
3:27:26
So no one has no one's if you're maybe you're talking about good faith after to those that you're not allowed or not allowed.
3:27:33
We you you do not apply for that until you submit your May 1 2025 report.
Memo Salazar
3:27:39
Okay.
Laura Popa
3:27:40
So we have no idea how many buildings are going to use that pathway as an option, as opposed to doing any of the other options.
Lincoln Restler
3:27:47
So it's after the May 1 2025 reports that will have a better sense of where this is going?
3:27:54
Or is it the it's the good faith effort.
3:27:56
It's the reports submitted after that?
3:27:59
What's what's the timeline where we're gonna have a better indication of how these folks are coming into compliance?
Laura Popa
3:28:04
Well, let me just say that we are following when an owner submits an application for work we do have a question that says, is any of the square footage in this work involved in 97?
3:28:17
And we've seen a substantial uptick in those.
3:28:20
So we are kind of watching.
3:28:21
And this is just like a claim you're making.
3:28:24
It's nothing to enforce.
3:28:25
Right?
3:28:25
Who's doing what you know, in in order to comply with 97.
3:28:30
So we're pretty happy with that.
3:28:32
But in the end, we're not gonna know if someone is meeting their emissions limits or deciding on a different option until they submit their report.
Lincoln Restler
3:28:41
And it's not until those reports are submitted that will have any indication that buildings are planning or hoping to take advantage of REX as well.
Laura Popa
3:28:50
That's right.
3:28:50
And as you know, if they have the decor plan, they can't.
3:28:53
Take advantage of Rex.
3:28:54
Yes.
