Proposal 5 part 1: Allow commercial use on second floor in C1/C2 districts

The first part of Proposal 5 would allow commercial uses on the second floor of mixed-use buildings in C1-C3 districts, in addition to the ground floor.

Currently, only community facilities like doctor's offices are allowed on the second floor in these areas. This change would provide more location options for businesses.

This is to allow commercial to exist over residential and also on the Second Floor in a C1C2 District.

We're going to talk about this one for a minute because we we made some change it and it also was a point of interest at the community boards.

Today, zoning allows for many buildings.

To have a mix of residential and commercial uses.

But zoning sometimes restricts businesses from being able to use upper floors of the buildings.

You can only do one story of commercial and C 1 or C 2.

You can only do one story of commercial if there's residential upstairs, even though you can have a doctor's office on the Second Floor.

You can have a doctor's office but you can't have any other commercial use on the second floor of a building and a C1C2.

That limits options for new buildings to be built that contain both residences and businesses, and also for older businesses to adapt over time.

So if doctor's office becomes vacant, you can't reoccupy that space with another business.

We also want to enable renovations or new construction of mixed use buildings in the places where it makes sense.

By allowing commercial uses at the same level or above residences provided there is complete separation.

As long as there is complete separation, we would allow for commercial to live above residential.

So first, let's talk about C 1 to C 3.

This is really the example of the doctor's office on the Second Floor.

In some areas of the city here are the ones that we're talking about, and you can see on the map where and floor of commercial is allowed today.

Community facilities can occupy the 2nd floor of mixed use buildings but offices and other commercial can't.

We are proposing to allow commercial uses to occupy the lowest two stories of a mixed use building rather than just the ground floor.

Commercial uses in that case can occupy the same floor as residents, can't be located above residential units.

This is applicable only in C1 to C3.

I will note this is already the rule in a number of areas in the city, c 4 to c 6.
