The Department of City Planning aims to rationalize the rules around home occupations to make them easier for the Department of Buildings to enforce.

  • By making the rules clearer, it will be easier for building inspectors to evaluate compliance
  • The current rules are unreasonable and make enforcement very difficult for the Department of Buildings
  • Modifications were made to the proposal to address concerns raised by community boards around enforcement

If you're going to expand home occupations, then we need more enforcement.
3:01:32
I know DCP is not in charge of enforcement.
3:01:35
But you are making this proposal.
3:01:37
So what are you doing to ensure DOB has the needed resources to actually address complaints about home based businesses?
Dan Garodnick
3:01:44
Well, first and most importantly, we are trying to rationalize the rules that they make sense and that they're easy to enforce.
3:01:51
For a department in buildings inspector, to show up and have to evaluate between a lawyer or interior decorator or otherwise.
3:02:02
Is something which is unreasonable and is something that we should not put on them.
3:02:06
It makes it very, very difficult for them to be able to do their jobs.
3:02:10
By rationalizing these rules, we believe that we're making life easier for enforcement of the Department of Buildings.
3:02:17
We also made a number of modifications in response to community board concerns on this subject to address those issues.

Thank you.
