The Department of Consumer And Worker Protection (DCWP) has no statutory or regulatory requirement specifying a timeframe to notify companies after a complaint is filed against them.

  • There is no law or rule mandating a deadline for DCWP to inform companies of complaints filed
  • Council Member Menin expresses concern over delays in resolving complaints, which can be prolonged if companies are not promptly notified
  • Menin urges DCWP to establish procedures to swiftly notify companies upon receiving a complaint
  • Commissioner Mayuga explains DCWP conducts thorough reviews, resulting in varying case resolution timelines
  • Mayuga states DCWP's process has successfully obtained restitution for workers while staying engaged with parties

Is there anything required either by the statute or via rulemaking that specifies a specific time upon which agency must let a company know that a complaint has been filed.

No.
0:19:44
There's no specific So

the reason for this line of questioning is I I am concerned it's taking the agency A VERY LONG TIME TO CLOSE OUT THESE COMPLAINTS.
0:19:54
AND CERTAINLY TO THE EXTENT THAT COMPANIES ARE NOT BEING NOTIFIED THAT CAN LENGTHEN THE TIME AT WHICH IT WILL TAKE to resolve a complaint.
0:20:02
So if a company is not being notified for 4 months, it's only gonna drag out the time that we can get the work or the relief.
0:20:09
So that's that's the reason why I'm very focused on this.
0:20:12
And I would really urge that the agency establish procedures to let companies know once in a very moditious fashion as soon as the complaint has been filed.
0:20:22
We need to shorten the time frame it's taking the agency to close out these complaints so the workers get the relief.

I I appreciate the concern, and and really just thank you for caring so much about the work.
0:20:33
As you said, obviously, our priorities to make sure that these laws are being followed.
0:20:38
There's compliance and that the workers get the restitution and that the rights are upheld.
0:20:43
We have followed a process that has really yielded tremendous success for not just a large number of workers, but like we've said in the tens of 1,000,000 of dollars in worker institution.
0:20:55
Some cases are resolved very quickly, some might take a little bit longer.
0:20:59
We want to make sure that we're doing a comprehensive review so that's sometimes the worker may come with an issue.
0:21:06
I mean, looking at the whole complain and the cases, the the documents that the company were provided to us.
0:21:14
We want to make sure that we're addressing any noncompliance, any violations all at once.
0:21:19
We don't wanna have to go back.
0:21:21
And we've been successful in in our work, in the way we're doing the investigations, staying in touch with the parties to make sure we can move things along as fast as possible, but it varies per case.
