QUESTION

What are the enforcement capabilities for preventing lobbying activities by political campaigners and vice versa?

The Committee Counsel states that the NYC City Council would be willing and able to enforce restrictions on lobbying activities by political campaigners and campaign activities by lobbyists.

  • It would require changes to the law and filing systems
  • There is currently a limitation as the law only covers compensated political consulting, not pro bono work
  • The Council would need to consult with the Office of Technology and address budgetary and technological constraints
  • But the Committee Counsel believes it would align with their current operations and enforcement capabilities

The idea is what we described in angel 742 and person who are active in political campaigns could not be lobbying and lobbying lobbyists who are active as lobbyists could not be campaigners, but if they are insistent on having the conversation between the campaign and the left in official.
1:04:25
So is that something that you could carry out in terms of enforcement?
1:04:30
Do you think you have the capacity to do that?
1:04:31
It does have an additional hyperperson perhaps.
1:04:34
And maybe what kind if it was to be the law, what kind of information would you need in order to enforce it?
1:04:43
I think the yeah.
1:04:44
Go ahead.
UNKNOWN
1:04:51
We would certainly be willing and able to carry it out.
1:04:54
It would require some changes but I also would like to point out that there is a limitation in the law because it it includes for compensation political consulting.
1:05:06
It does not include political consulting and fundraising that is done pro bono, that is not compensated.
1:05:13
So that is an important distinction.
1:05:16
And it does have an it does curb the amount of reporting that is that is engaged in by lobbyists, for example.
1:05:23
Because if they're not compensated for their political consulting, they do not have to disclose it.
1:05:29
But we could certainly undertake, you know, with proper legal changes, we would be able to carry carry it it would you know, we'd have to make technological changes to our filing systems, which obviously is not you know, we'd have to do that consultation with OTI, and there's budgetary constraints and technological issues that have to be worked out.
1:05:49
But we do feel that it would be in line with our current operations and enforcement, and that we would be able and willing to to follow any policy changes.
