QUESTION

What is the verification process the Conflicts of Interest Board (COIB) follows to assess the credibility of alleged violations?

The COIB conducts a formal investigation, including obtaining documents and interviewing witnesses, when allegations of conflict of interest violations are reported publicly.

  • For post-employment violations involving former employees, the COIB can act quickly if there is evidence of prohibited communications within the first year after leaving their job.
  • In such cases, the person who received the prohibited communication often alerts the COIB, providing sufficient evidence to establish a violation.
  • The COIB aims to prevent further prohibited conduct by former employees once alerted to potential violations.

So in the event that you have a clear cut violation of the conflict of interest law being alleged to you, a complaint is submitted to you.
1:10:04
What level of verification do you engage in about whether or not this is I guess, what level at what point does it become actionable in your view?
1:10:12
Because it's possible someone makes a frivolous complaint, it's possible someone just makes something up, and it may even get reported on publicly.
1:10:21
So what's what kind of assessment do you engage in, whether or not that specific allegation is even credible?
Carolyn Miller
1:10:29
Yeah.
1:10:29
So in so right.
1:10:32
So if something is reported in the press, almost always, it's gonna require a form investigation by the department investigation obtaining documents, interviewing witnesses, and the like.
1:10:41
In the post employment context, sort of neakly is that often when we get complaints, the person who was the sort of recipient of the prohibited communication is telling us, hey, former employee, Sheila, was at this meeting, and it she stood she just left the agency 6 months ago.
1:11:00
So both for the goals of, like, that's enough evidence for us to establish a violation and because we want to prevent the former employee from engaging in any additional prohibited conduct, we would proceed with that evidence that we had already.
1:11:17
So the post employment 1st 1 year ban violations are sort of the ones we can move most quickly on.
