The deputy commissioner explains that for property owners to receive J51 benefits for rental buildings, they must demonstrate during the application process that at least 50% of units are rent-stabilized and rents are below 80% of the area median income.
- Owners submit an application after completing eligible work on their property.
- As part of the application, they must provide evidence that the building meets eligibility requirements.
- For rental buildings, this means at least 50% of units must be rent-stabilized.
- Additionally, the rents for those rent-stabilized units must be below 80% of the area median income.
- The department will not issue a certificate of eligibility unless the owner can prove these criteria are met.
- There are some exceptions where different requirements apply, such as for Mitchell-Lama buildings.

In terms of the data that is being maintained, is there a list of units with either missing information or registration, that you keep in order to to triage or or or check into the eligibility.

So at the point of application, the owner needs to so going forward for the new program, the way this will work is the applicant decides they wanna apply for J51, they do the work, they submit the application to us.
