Council Member Riley inquires about how the applicants are addressing Community Board 9's concerns regarding the proposed development near an active railway. The applicants explain the safety measures, including Amtrak's approval process, sound attenuation, and environmental impact studies.

  • Amtrak's approval is required for any construction in the right of way
  • Environmental assessment found no significant noise impacts with proper attenuation
  • Minimal to no impact on site lines from the building

Could you please detail how are you addressing CB Nine's concerns?
Neil Weisbard
0:37:10
So, honestly, I know some members of CB Nine are here is that their their main concern was the occupants of the proposed building and their safety of being next to a active railway.
0:37:21
And as I've mentioned, and and I can read specifically from Amtrak's report that no construction in the right of way can occur until applicant require some Amtrak.
0:37:33
The real estate rights necessary to construct the improvements in the right away.
0:37:37
If Amtrak agrees to convey the necessary real estate rights to the applicant, any proposed construction will be subject to Amtrak's prior review and approval, which approval may be granted withheld that Amtrak's sole and absolute discretion.
0:37:49
So Amtrak will not approve this until they believe that the the railway is compatible with the building.
0:37:58
And maybe Jason can speak to some of the sound attenuation and Steven to the vibration.
0:38:03
To address those concerns of the occupants of the building?
Jason Diaz
0:38:06
Sure.
0:38:07
In terms of sorry.
0:38:09
In terms of noise Yeah.
0:38:13
Yeah.
0:38:13
Yeah.
0:38:13
Sorry.
0:38:14
My name is Jason Diaz.
0:38:15
I'm with VHP, the environmental consultants.
0:38:17
Working on the project.
0:38:19
We we prepared the EAS in accordance with seeker, and the noise analysis found that, you know, there would be no significant impacts to any residential uses on the property.
0:38:32
There will be noise attenuation requirements for those sensitive uses to avoid those impacts.
0:38:40
But like I said, we we studied, you know, both like We studied mobile source analyses both for vehicles and the existing train uses along the Amtrak line.
0:38:54
And, again, both were found to not result in significant adverse impacts as long as the noise attenuation requirements are met, which will be enforced by an e designation.
Neil Weisbard
0:39:07
And I also just as I showed in those slides that it if the community board does have concerns about impacts of the building on the site lines, I show that there really is minimal to no impact.
