Council Member Chris Banks inquires about the role of marshals in NYCHA's eviction process and the recourse available for tenants who feel mistreated by marshals. Hannah Roth explains the use of marshals and accountability measures.

  • Marshals are required to be used as part of the eviction process and for serving notices.
  • The Department of Investigation oversees the marshal service for the city.
  • NYCHA has contracts with marshals and can address concerns about their conduct.
  • Tenants can report issues to the Department of Investigation, NYCHA's law department, or property staff.

Right.
0:54:36
How was Nitra you how do you use the marshals and the eviction process?
0:54:41
How's that being done?
Hannah Roth
0:54:43
Yeah.
0:54:43
So the marshals are required to be used as part of the eviction process.
0:54:49
An eviction warrant can only be requested by someone who is a formal marshal from the housing court, and then they are responsible for executing the warrants of eviction, so they are formally required at the end.
0:55:02
We also rely on the marshal service to do a lot of the service of process.
0:55:06
So when we serve residents, those preliminary notices, the marshals serve those on our behalf.
Chris Banks
0:55:12
K.
0:55:13
And what recourse is available for those who find themselves being mistreated by the marshals?
Hannah Roth
0:55:21
There's the Department of Investigation oversees the marshal service.
0:55:25
For the city.
0:55:27
So they can certainly file a report or do outreach on that end.
0:55:31
If there's something that happens in a nitrile related eviction, we encourage tenants to let us know.
0:55:36
They can always reach out to the law department.
0:55:39
Or their property staff and let us know if there's something that they're seeing.
Chris Banks
0:55:42
Does night you have the ability to hold the marshals accountable?
Hannah Roth
0:55:47
Yes.
0:55:48
We
Chris Banks
0:55:49
Can you explain that out?
Hannah Roth
0:55:50
Yeah.
0:55:50
So the marshals for all the service of process.
0:55:54
Those components are done by contract with Nitro.
0:55:57
So if we have a marshal if there was a marshal who there were concerns about, we could certainly talk to them and try to resolve those issues on an ongoing basis.
Chris Banks
0:56:07
Is the sheriff's office?
0:56:08
Do you use the sheriff's office for evictions also?
Hannah Roth
0:56:11
We do not.
0:56:12
Okay.
