Council Member Sanchez inquires about the criteria HPD would consider when approving or declining a corrective action plan. Deputy Commissioner Darga outlines the factors HPD can take into account.
- Current program rules allow HPD to consider various factors, including ability to make payments and proof of ability to pay
- HPD can account for whether payment sources would further destabilize the housing
- Other factors include property conditions, existence of violations, and findings of resident harassment
- After the judgment of foreclosure, there should be clear requirements showing that conditions will be addressed, not just proposals
- Flexibility in decision-making is helpful, but clear expectations for addressing issues are necessary

Thank you.

As as written, the legislation gives HPD the discretion to approve or decline a corrective action plan, what criteria would the department consider when making such a determination?
Kim Darga
1:40:14
Yeah.
1:40:15
So, again, I think this is so in the current program, there is discretion for HPD pursuant to the rules to account for a range of factors.
1:40:31
And those factors include ability to make payment.
1:40:35
They're actually supposed to be proof not just an intent to pay, but proof of the ability to pay as well as and that the, you know, the HPD can account for whether those sources would further destabilize the housing or not.
1:40:53
So just because there is money doesn't mean that the city needs to accept payment toward the end of an interim action.
1:41:03
There is also requirements that we can account for conditions of the property, including the existence of violations.
1:41:16
There are a range of other factors we can account for, including findings of harassment of residents, So there's a very long list of characteristics that the city can account for and looking at whether we would accept payment.
1:41:35
I think having flexibility is certainly something that could be helpful.
1:41:41
But we also think that after the judgment of foreclosure, there needs to be clear requirements that show that the conditions will be addressed and not just a proposal for addressing them.
Pierina Ana Sanchez
1:41:57
I can get on board with that.
1:41:59
Thank you, deputy commissioner.
1:42:01
So I lost my train of thought for a second.
1:42:07
I blame you, baby.
1:42:09
No.
1:42:09
Baby baby is perfect.
1:42:11
So they do get upset when I lean in.
1:42:12
They're like, nah, my children.
1:42:19
Oh, yes.
1:42:20
Okay.
1:42:20
Now I remember.
1:42:21
Thank thank you for your patience.
