The Brooklyn Yards project involves building over an active rail cut owned by the Long Island Railroad, presenting unique challenges and opportunities. This feature necessitates multiple zoning applications and special permits.
- Rail cut is below grade and currently used for limited freight service
- Potential site for future passenger service (IBX project)
- Developer has rights to build over the tracks at a certain height, with approval from railroad authorities

Okay.

And that is that the line that dissects the site will zoom in in a moment is actually a rail cut.

It's a right of way.
0:13:39
It's below grade.
0:13:41
It's owned by the Long Island Railroad.
0:13:43
It's used currently for limited freight service, but is also the place where governor is proposed, passenger service known as the IBX, because the rail line runs from Bay Ridge all the way up to up to Queens.

There's 3, I think, key facts out the history of this project.

One is is that about 40 years ago, the property was owned by Conrail, not the Long Island railroad, and they sold to my client's predecessor entitled, the right to build over the rail tracks at a certain height, and the right to put columns down to hold up the platform that would support the support the housing.

It's subject to their design approvals and and many other aspects, as you can imagine.

My client bought a portion of the development area.
0:14:40
It's not development rights.
0:14:41
It's actually a fear of a plane, my client bought 3 blocks in this in this area.
