Council Member Jennifer Gutiérrez questions Alex Foard from OTI about agency compliance with Local Law 35 and changes in reporting methodology. They discuss the shift from executive order 50 to Local Law 35.
- OTI reports 100% compliance from agencies for all 4 years
- The methodology for reporting changed with the shift from executive order 50 to Local Law 35
- The change reflects the creation of OTI through executive order 3 and the implementation of Local Law 35
- Previous reports reflected the process from executive order 50, while current reports follow Local Law 35 requirements

Okay.
1:23:24
Were in this last report, in this 2023 report, and looking into 2024, have there been any obstacles to ensure compliance of local o 35 with agencies?
Alex Foard
1:23:34
No.
1:23:34
We've had a 100% compliance for all 4 years.
Jennifer Gutiérrez
1:23:39
Excellent.
1:23:41
All reports prior to 2023 listed the number of tools reported and the number of tools identified.
1:23:49
Did the methodology of compliance with the law change?
1:23:52
And why is there no longer reporting on the number of tools identified?
Alex Foard
1:23:57
Sure.
1:23:57
That reflects the shift from executive order 50 for what was formerly executive order 50 of 2019.
1:24:03
Which was when OTI was created through executive order 3, those responsibilities for algorithmic management shifted to OTI, and that's also when local law 35 took effect.
1:24:14
And so the previous reports just reflect the process from previous years, the reports going forward include the process for local law 35.
