Council Member Williams inquires about CCHR's success rate for employment-related claims brought before the Office of Administrative Trials and Hearings (OATH). Deputy Commissioner Carroll discusses the litigation process and CCHR's high success rate.

  • Most cases referred to OATH settle through mandatory settlement conferences
  • Only one employment case that went to trial in the last ten years was unsuccessful
  • CCHR referred over 26 cases to OATH in the last fiscal year

Does CCHR track its success rate for employment related claims brought before oath?
0:30:09
If so, what is it?
Katherine Carroll
0:30:13
Thank you for that question.

It's very exciting when I get to talk about our litigation work because it's it's the fun fun part as a lawyer, what we get to do.
0:30:21
So I think, first, when we refer a case to Oath, it's after there's been a probable cause determination in an investigation, and we've been unsuccessful at settling it without taking it before an administrative law judge.
0:30:30
So it tracks, really, the the resistant employers who who don't want to comply with the

law and want to

really go to battle with us on a particular case.
0:30:39
The bulk of our cases that we refer to Oath do settle through the mandatory settlement conference that we're required to appear before before we can take a case to trial.
0:30:53
And then once we take a case to trial, I'm happy to say that only one employment, case that went to trial were unsuccessful in in the last ten

years?
0:31:04
And compared to how many cases actually went to trial?
Katherine Carroll
0:31:08
It's I'm also only aware of 1 in the last 10 years or housing cases that we were unsuccessful.
Nantasha M. Williams
0:31:13
Okay.
0:31:13
So you only have one case, and the one case you did have was unsuccessful?
0:31:18
How many cases.
0:31:18
Oh, I have How many cases in total have you brought to court?
Katherine Carroll
0:31:22
Oh, I'm sorry.
0:31:23
Not in which
Nantasha M. Williams
0:31:24
And then you said one was just only one was unsuccessful.
0:31:27
So I was just wondering how many cases have been brought to court.
Katherine Carroll
0:31:31
The number of cases that have gone to trial, I don't have offhand, but we have referred, over 26 in the last fiscal year.
0:31:41
And we're continuing to push forward in trying to move, the cases we take to litigation so that we can expand the jurisprudence on this extremely broad statute that we have.
