Christopher Gawarecki from HUB Truck Rental Corporation testifies in support of pre-considered legislation regarding the transfer of liability for idling violations from vehicle owners to lessees. He argues that this change would align with practices in other departments and reduce administrative burdens on leasing companies.
- HUB Truck Rental has 627 leased customers in the New York metro area
- The legislation would apply to long-term lease customers (6-7 years), not short-term rentals
- Currently, HUB acts as a middleman, receiving violations for their lessees and facing administrative challenges in processing them

Good afternoon.
2:25:11
Nice to see the committee.
2:25:12
Thanks for letting me testify.
2:25:14
My name is Christopher Gabarecki with Home Truck Rental Corporation.
2:25:18
We have approximately 627 leased customers that operate in the New York metro area.
2:25:25
We strongly support, the pre considered, legislation here, regarding the transfer of liability.
2:25:33
Every other department has it.
2:25:35
The New York City Department of Finance has it.
2:25:37
For parking tickets, EZ Pass has it.
2:25:41
Most law enforcement agencies have it.
2:25:43
We're not talking about short term rentals, transient customers that have a truck for a day, 2 days, a week.
2:25:50
We're talking about lease customers with a certified lease that have these trucks from approximately 6 to 7 years, and the trucks are clearly marked with the less ease information, including the name, the address, and the DOT.
2:26:06
I've attended a lot of these hearings, since they are written to HUB because we do own the trucks, but it's quite frustrating when you see a violation that is written to the lease customer with the lease customer's information, and then it's resulted in HUB receiving the violation.
2:26:27
So, basically, HUB Truck Rental is the middleman.
2:26:31
We do not charge our lease customers outright.
2:26:34
We send the violation to them to see how they wanna handle it.
2:26:39
If they do not handle the violation, then we'll pay the fine, invoice them back, or attend the hearing.
2:26:46
So this has been a huge administrative burden on the leasing industry.
2:26:51
And, again, we're not talking about rental trucks.
2:26:53
Rental trucks have Hub's lettering on it.
2:26:55
That I can see Hub receiving.
2:26:57
It's long term lease customers that are getting these citizen idling violations.
2:27:05
They're not getting them some of them are getting them directly, and then others are sent to HUB, which then we have to send to the lease customer.
2:27:15
So administratively, every other law enforcement agency, red light camera tickets, school bus camera tickets, there's always a transfer of liability option.
2:27:26
That's why there is a certificate of lease.
