Council Members Jim Gennaro and Robert F. Holden discuss which agency should be responsible for enforcing regulations on 53-foot trailers in New York City. They explore the potential roles of DOT, NYPD, and other agencies in addressing the issue.

  • Gennaro suggests DOT might have some enforcement ability
  • Holden expresses frustration with the lack of progress over 30 years of efforts
  • The discussion reveals a cycle of agencies deferring responsibility to each other

I I I did I just wanna follow-up with with, customer Holden.
1:09:57
Wouldn't wouldn't DOT be an entity that might have some ability to weigh in on the 53 foot?
1:10:06
I mean, I don't know the extent to which I mean, they have an enforcement apparatus.
1:10:14
You know, these are transportation vehicles.
1:10:16
And have you tried?
Robert F. Holden
1:10:21
I've tried.
1:10:21
This is going this is thirty years of working on this and always a dead end.
1:10:27
Always a dead end because the industry seems to dictate because they it's economical.
1:10:33
You know, it's like, well, we can't we we 53 footers are illegal in New York City and but we have to move the most goods the the best way we we know how.
1:10:46
We can't change for New York City.
1:10:48
We won't change for New York City.
1:10:50
So it needs legislation.
1:10:52
Well, I I but it but it
Jim Gennaro
1:10:54
maybe doesn't because we already have the legislation.
Robert F. Holden
1:10:56
We have the legislation but
Jim Gennaro
1:10:57
is illegal.
Robert F. Holden
1:10:58
But I I again, there's there's got to be incentives for the for the industry to change to waterways and also to get away from the 53 footers.
1:11:07
And, you know, unless we get electric 53 footers
Jim Gennaro
1:11:11
Yeah.
1:11:11
But I I I I I think for now, just just, you know, making a note of, you know, counsel to the committee and my own and and my own own legislative director, I mean, you know, we we should talk to the transportation chair.
Robert F. Holden
1:11:28
I we have.
1:11:30
And the answers are, well, it's NYPD to enforce.
1:11:33
And then NYPD says, well, so, you know, we don't have the personnel to enforce this.
1:11:38
And then back to DOT.
1:11:40
And so we this is how we go around in circles.
1:11:43
Okay.
1:11:43
But I'm looking at the Commissioner of DEP just for because it way stations come in, and I do coordinate with state DOT in Mass Beth, because this is a big problem in Mass Beth.
1:12:11
Air pollution, we have the LIE running through our neighborhood.
1:12:14
So we have a lot of truck traffic.
1:12:17
And when you have 53 footers compounding the problem, we go around in circles.
Jim Gennaro
1:12:22
Yeah, it just drives me nuts when you have something that's blatantly illegal and, you know, entities just indicating that would we're just gonna let it go.
