Council Member Alexa Avilés questions Carina Kaufman-Gutierrez about the doubling of criminal summonses issued to street vendors. They discuss the discretionary nature of officers issuing these summonses.
- The number of criminal summonses nearly doubled from 1,244 in 2023 to 2,037 in 2024.
- Kaufman-Gutierrez explains that the decision to issue a civil or criminal summons is at the discretion of the individual officer.

Thank you.

Karina, in terms of the criminal summonses and the doubling of the numbers, is that what is determining at this point when an officer gives a criminal summons?
6:03:53
Is that completely discretionary in your view or what is moving that or driving it?

Our understanding is that it's discretionary per the officer issuing the summons, whether they issue a civil or a criminal summons.
