EEPC's process for non-compliant agencies

Executive Director Jeanne Victor outlines the steps EEPC takes when an agency is found not to be in compliance with equal employment opportunity requirements. She describes a three-tier approach to addressing non-compliance.
- Non-compliant agency heads may be required to meet with the EEPC board
- Agencies may receive a certificate of non-compliance and be audited again the following year
- Non-compliance is reported in EEPC's annual report to the mayor's office and city council

And I know this is a question we have asked often but I always think it's important to acknowledge, I'd argue the lack of teeth that you have sometimes around holding agencies accountable.

So there were three things that pretty much happen.

If an agency is not in compliance by the end of their compliance monitoring period, I have been advising the agency heads that they will need to come before our board and speak with our board as to why they have not been in compliance and when they expect to be in compliance.

So far we have not had to resort to that.

The second thing is is that they could receive a certificate of non compliance and then they would be audited in the following calendar year.

We've had that happen on a couple of occasions since I've been here, which will be four years next month.

And the the last thing is that we would make the make a statement in our annual report which goes to the mayor's office and goes to city council as to the fact that we have an agency that has not been in compliance.

Can you share the agencies that are not in compliance based off of your last report?

So fortunately as of our last report we all the agencies were in compliance.
