Council Member Cabán concludes her questioning with criticisms of NYPD's internal processes for handling CCRB recommendations and officer discipline.

  • Cabán points out that 267 cases were dismissed under Commissioner Tisch's tenure
  • She criticizes NYPD's 'extrajudicial process' of reinvestigating cases before they go to the deputy commissioner of trials
  • Cabán argues this process is duplicative and not established by city charter or civil service law
  • She contends this process effectively reduces the statute of limitations and provides another avenue for NYPD to avoid disciplining officers

I know that I have to turn it back to the chair, so I I just wanna conclude despite not being able to ask these questions.
1:34:15
I just wanna con conclude that what the NYPD has described, as the process.
1:34:20
And under your tenure, commissioner Tisch, that that number is 267.
1:34:25
But in previous testimony on this issue, the NYPD described an extrajudicial process in which the department advocate's office reinvestigates cases before they are tried before the deputy commissioner of trials.
1:34:35
And so my point here is that this is an entirely duplicative internal process that's not established by the city charter, MOU with the CCRB, or civil service law.
1:34:44
So in most instances, the NYPD requests the CRB to transmit these cases more than thirty days before the statute of limitations, effectively reducing the statute of limitations and providing another avenue for NYPD to not discipline officers for substantiated misconduct.
1:34:59
So my point here is that this is a duplicative process that shouldn't be happening.
1:35:04
There are other processes in place, and this is resulting in more dismissals of disciplinary cases.

Thank you, chair.
