Council Member Pierina Ana Sanchez requests detailed information on the number of units affected by HPD and DOB vacate orders. Representatives from both agencies provide available data and explain some limitations.

  • HPD reports that for calendar year 2024, 341 units were affected by full fire vacates and 721 units by partial fire vacates.
  • DOB initially provided numbers in terms of properties/buildings rather than units. For 2024, they reported 1,656 vacates, with 289 completely lifted and 175 still active (45 full vacates and 130 partials).
  • DOB acknowledges they don't have unit numbers readily available but could potentially determine them. They also note that some vacates don't impact occupancy (e.g., rear yard vacates).
  • The discussion highlights the need for more comprehensive and readily available data on affected units.

A quick follow-up on the numbers that you shared around vacate orders for HPD and DOB.
1:38:39
Do you have the number of units associated with those vacate orders, not just property numbers?
AnnMarie Santiago
1:38:47
For for HPD fire only vacates, we have approximately 11 for 20 I'm sorry, for for calendar year 2024 I gave you the numbers, right?
1:39:07
Mhmm.
1:39:08
We had 341 units affected by full fire vacates and 721 units affected by partials.
Pierina Ana Sanchez
1:39:16
Got it.
1:39:19
And Department of Buildings, you mentioned sixteen fifty six vacates, 39 partially lifted, two eighty nine completely lifted, 45 full vacates and 130 partials that are still active.
1:39:31
Do you know how many are those property numbers or unit numbers?
Yigal Shemash
1:39:35
Those are property numbers or number of buildings.
Pierina Ana Sanchez
1:39:39
Okay.
1:39:39
And do you have the number of units affected?
Yigal Shemash
1:39:41
I don't have it here.
1:39:43
I think we could determine that number.
1:39:50
Some some of our vacates are not related to occupancy or or number of units.
1:39:59
A lot of our vacates are for rear yards, side yards that do not impact occupancy.
1:40:08
And and we can also break down how many of those vacates are for fires, but I believe the large majority of our vacates are for actually compromised egress with related to illegal occupancy.
Pierina Ana Sanchez
1:40:21
Okay, thank you.
1:40:25
I should have asked this when I was asking about all of the information what information is told to residents about whether they can go back in.
1:40:34
Before you rescind a vacate order, that would be a moment in time in which you could require that the landlord or the owner prove to you that they've communicated to residents, but that that question is not asked in in the rescinding of vacates order, vacate orders in either agency?
AnnMarie Santiago
1:40:54
I don't know that we would ask that before the resend because we wouldn't want the landlord to notify the tenant before the resend.
1:41:02
We would want the landlord to notify the tenant at the time of the resend or after the resend is issued.
1:41:10
So again I can go back and I'll speak with our special enforcement unit about that exact communication and how that happens and we can provide that information to you.
