Michael Gerber presents the NYPD's position on Intro 125 and requests a narrow exception for specific circumstances involving juvenile suspects in serious crimes.
- Asks for an exception when a juvenile is suspected of committing a class A or class B violent felony
- Proposes that in such cases, investigators should be allowed to collect DNA with permission from the Chief of Detectives
- Emphasizes that this would be a rare occurrence, applicable in extreme cases like murder or rape investigations
- Expresses willingness to work with the council to refine the legislation

                                            0:27:55

We would only ask that there be a narrow exception applicable when the juvenile is suspected of committing a class a or class b violent felony, and the investigators have received permission from the chief of detectives.

                                            0:28:11

This will be a rare event.

                                            0:28:13

But in a situation in which a juvenile is, for example, a suspect in a murder or rape, the chief of detectives should be allowed to authorize an otherwise lawful collection of DNA from a juvenile pre arrest.

                                            0:28:31

We look forward to discussing this legislation further with the council and working towards a bill that gives additional protection to juveniles while still allowing for exceptional circumstances in which this investigative step is permissible.
