Council Member Brooks-Powers inquires about guidance provided by the Department of Consumer and Worker Protection (DCWP) to DOT on managing the sidewalk cafe program. DOT officials discuss their interactions with DCWP and the process of determining rules for the current program.

  • DOT held several meetings with DCWP to discuss their experiences and processes
  • A quarterly task force meeting with DCWP and the Department of City Planning is held as required by legislation
  • Some program requirements are dictated by the city charter and local law, limiting flexibility in rule changes

Did CWP provide any advice or guidance to DOT on management of the sidewalk cafe program before local law one twenty one transferred it to DOT?
Margaret Forgione

I know we had several meetings with them to talk over their program, their experiences, and the process.

We've also the legislation required us to hold a quarterly task force meeting with DCWP and the Department of City Planning, and we've been doing that since the legislation passed.

Because I believe I've I've been told that, I guess, the the rules in the current program are not, you know, a mirror image of what it was prior to local o one twenty one.
1:59:39
And so having the, learned lessons from the previous program, I'm wondering how DOT used that information to determine what the rules would be for this current program?
Margaret Forgione

Right.
1:59:57
So I think, again, the sticking point are some of the requirements that are just in the charter and the local law, so even understanding some of those issues didn't necessarily mean we could avoid them.
