Council Member Salaam inquires about follow-up investigations and risk assessment in NYPD vehicle pursuits. Josh Levin explains the department's approach:

  • Clear parameters are set for initiating, continuing, and terminating pursuits
  • Documentation is required for all pursuit-related decisions
  • Risk assessment considers factors such as speed, environment, weather, and vehicle information
  • Officers make individualized determinations based on training and experience

The NYPD emphasizes the importance of human judgment in assessing the totality of circumstances during pursuits.

What follow-up investigations or enforcement occurs in circumstances when the NYPD decides to discontinue a vehicle pursuit and how does the department assess risks versus reward when initiating or continuing a pursuit?
Josh Levin
1:48:05
Yeah.
1:48:06
I think the idea is to provide clear unambiguous parameters for when to initiate, continue, and terminate the pursuit.
1:48:13
It also requires the documentation of all that.
1:48:16
I think it comes down to a multitude of factors.
1:48:20
So I mentioned some of them earlier.
1:48:23
The speeds, how dense the environment is, if it's like a public school near a public school, that's gonna be different than the Bell Parkway at 3AM.
1:48:31
The weather, the lighting, reports they may have about the car, etcetera.
1:48:36
These things, you can't plug this information into a computer and have it spit out time to pursue.
1:48:41
Right?
1:48:41
Human beings are making these individualized determinations in the heat of the moment given the totality of the circumstances with the best judgment of what their training is and versus what their experience is.
