Council Member Rita Joseph discusses the alignment of Carter case budgets with actual spending, noting significant variations between fiscal years. DOE representatives explain the challenges in estimating costs and their ongoing monitoring efforts.

  • The FY 2025 budget for due process cases has grown from $664 million to $1.3 billion
  • The FY 2026 budget is currently set at $934 million, which is above the 2025 adopted budget but below the current FY 2025 amount
  • DOE continues to monitor costs, especially those from prior years, and works with OMB to adjust as needed

So I understand that the Carter cases, the cost is varies year per year, right?
2:46:22
The council is continuing for administration to align Carter case budget with actual spending.
2:46:27
So at the fiscal twenty twenty five budget for due process cases was $6,646,000,000.
2:46:33
As I mentioned earlier, this was grown to $1.31300000000.0 in the current plan.
2:46:39
So the fiscal twenty twenty six budget is currently 934,000,000, which is well above the 2025 adopted budget amount and well below the current fiscal twenty twenty five.
2:46:50
So, do you believe that the current fiscal twenty twenty six budget is more realistic in estimating costs and spending in previous fiscal years at adoption?

I can answer that one for you.

So, we again continue to monitor especially because a lot of our costs come from prior years and so we will work with OMB to true up as we as the bills are coming in, but I can't say right now that it is it's enough indicative of the drop that we've been seeing
