Council Member Rita Joseph inquires about the process of rolling over services for students with Carter cases to the next school year. DOE General Counsel Liz Vladek explains the factors considered in this process.
- The rollover of services depends on what's specified in the student's IEP
- If a family argues that a child was entitled to services they didn't receive and still needs, DOE will provide compensatory services
- Students are evaluated every year, and their progress is monitored to update their IEP
- The IEP should reflect what the student needs during that specific academic year

And students who are getting Carter cases, if they don't receive the service in due time, it allowed to roll over for the next school year?

How does that work?
Liz Vladek
2:50:27
It depends on exactly what's on the IEP.

So where a family is arguing is stating that they were entitled to services that the kid didn't get and still needs.
2:50:40
We will provide compensatory services but of course we have to evaluate kids every year.
2:50:45
We have to monitor their process and update their IEP.

So at any given moment in time the IEP should reflect what that student needs during that academic year.
