The special permit is knee knee needed to mass the building as a tower.

The heightened set EPAC rules under applicable here don't allow a tower form, a tower massing where you have a commercial space in the tower pool pool portion.

So in order to have this space at the top of the building and to have it classified as a commercial space that would kick kick us out of being able to you use the tower regular regulations.
