Patreinnah Acosta-Pelle, a shareholder at Esplanade Gardens, testified in opposition to the One45 for Harlem development project. She raised concerns about potential violations of fair housing laws, the risk of bait-and-switch tactics by developers, and the environmental impact of the proposed buildings.

  • Argued that the project would violate the Fair Housing Act, anti-discrimination laws, and Section 2 of the Voting Rights Act
  • Expressed concern about the scale of the project, citing two 400-foot buildings as "insane" for the area
  • Highlighted potential environmental issues, including increased carbon emissions and health risks
  • Suggested the developer should build "as of right" using the existing 40,000 square foot allowance

Hi.
Vivian Morgan
1:35:41
Oh.
Patreinnah Acosta-Pelle
1:35:45
Can you see me?
1:35:47
Okay.
1:35:47
Yes.
1:35:48
Good afternoon.
1:35:49
Good day subcommittees.
1:35:50
My name is Patrianna Acostapel, and I am a shareholder at Espinal Gardens.
1:35:56
So I'm gonna just touch on some things because I've been opposing this project since 2021.
1:36:01
So the first one is if if one four five is approved, it will violate the Fair Housing Act and anti discrimination laws, section two of the Voting Rights Act.
1:36:11
Two, city council should be aware of the history regarding bait and switch with developers.
1:36:16
Your own councilman and chair, Salmata junior, has pointed this out in a few land use committee meetings, talking about how when projects are approved, they are now bait and switch with the developer cells.
1:36:29
Meaning, many times, the presentation of monolithic projects does not get developed by the presenting developer, but by his assignee who has no obligation to the promises, community benefits agreements made by the original developer.
1:36:42
Such assignees are often with no connection to the community, state, country other than being allowed to enter into contracts.
1:36:50
Benefit agreements mean nothing.
1:36:52
Number two, I just want you guys to visualize.
1:36:55
Two four hundred feet buildings on A Hundred And 40 Fifth Street and Lenox Avenue.
1:37:01
That's just insane.
1:37:03
It's already a highly dense populated area with high carbon footprint, which will create over 3,000 more people.
1:37:11
This will literally take the oxygen out of the community.
1:37:14
It will create more carbon emissions and rise and and rise in health concerns of the community.
1:37:20
Number four, I also concur with the reports and the other information presented by mister Julius Tahaja regarding the dangers of liquefaction and the potential catastrophic events that can happen as a result of this property being built, especially when we are in such a high risk area.
1:37:37
It's already Expired.
1:37:39
Thank you.
1:37:39
Hurricane zone and so forth and so on.
1:37:43
So therefore, I would just like to say Bruce just needs to build as of right.
1:37:48
He mentioned that earlier.
1:37:49
He has 40,000 square foot.
