Public member Rod Herbert advises against changing the ULURP process, recommending instead an 'operational self-assessment' involving diverse stakeholders to identify improvements. He notes that terms like 'as of right' development provoke fear among homeowners and long-term residents concerned about displacement or negative impacts like loss of solar access.

  • Herbert advocates for improving the existing ULURP process rather than replacing it.
  • He suggests a structured self-assessment involving all parties to rebuild the process effectively.
  • He highlights community anxieties surrounding 'as of right' development.

Alright.
2:02:19
So I'll I'll be quick.
2:02:20
I don't know if I could follow a discussion like miss Boyd, but I'll be very brief.
2:02:26
Alright.
2:02:26
So with regards to the process, right, many of my bosses have told me in the past that if there's a problem within a certain process, don't look to change it, but look to improve on it.
2:02:39
Right?
2:02:39
So how do you improve on it?
2:02:42
What's almost an operational self assessment.
2:02:44
Right?
2:02:44
Not just have five, six, or four people in a room to discuss the EULA process and make a change.
2:02:50
You have to have a broad scope of individuals together in a room, have them tear apart the process, and then rebuild it.
2:02:58
It's a painful, painful process to go through.
2:03:01
Right?
2:03:01
I've done about 12 operational self assessments, right, for large projects and small projects.
2:03:08
It does work.
2:03:10
Right?
2:03:10
And the concern that many of the community boards have when I speak to other community board members is the term as of right.
2:03:18
Because what happens is that many of the homeowners and the long term long time community members, they feel that they're going to be pushed out.
2:03:27
And that's how they look at that term as of right.
2:03:30
Right?
2:03:30
I also know a couple of people in Queens that as of right scares them because they have these solar panels on their homes, and they're afraid that they will no longer have the use of their of the sun to use their solar panels because of Azerite construction.
2:03:44
Alright?
2:03:45
So what happens?
2:03:45
You have a process.
2:03:47
Don't look to change it.
2:03:48
Look to improve it.
