Commissioner Carl Weisbrod asks about the significant drop in the Police Commissioner upholding CCRB recommendations (from 80% under O'Neill to 30% currently), questioning if factors beyond the commissioner's views are at play.

Abdul Nasser Rad emphasizes the long-term average discipline rate remains extremely low (<2%) regardless of yearly fluctuations, highlighting the underlying structural issue of commissioner discretion.

Hassan Naveed reiterates that the decision rests solely with the commissioner under the current system.

Carl Weisbrod
2:14:38
Yes.
2:14:39
I I was struck by the testimony before you that under commissioner O'Neill, eighty percent of the CCRB disciplinary recommendations were upheld, and now 30% are upheld.
2:14:55
Is that dramatic change simply due to the views of the commissioner or are there other factors at play?
2:15:48
I'm I'm just not sure you're answering my question or maybe you're not capable of answering my question.
2:15:53
But is it is it the dramatic change simply due to the views of the commissioner at the time?
2:16:02
Or are there other factors at play?
2:16:04
For example, the different nature of cases that are determined by the CCRB now versus Sure.
2:16:19
Ten years ago or eight years ago with commissioner O'Neill?
Abdul Nasser Rad
2:15:03
I mean, I won't be able to speak to what the commissioner's thinking on those things.
2:15:11
As we stated, the issue is around the structures and as Hassan's mentioned, who's at the helm.
2:15:18
And we're trying to advocate for a system where who's at the helm does not dictate accountability.
2:16:21
Let me try to respond to that, commissioner.
2:16:24
So as I started, the data that from 2,000 to 2020 still showed that administ that NYPD administered in still fewer than 20 than two percent of cases.
2:16:35
So that is the data for two decades.
2:16:37
Now commissioner O'Neill being sort of having a a different administration of or a compliance, whatever you'd like to call it, that can't say what the case is for that year, but on average is what we're talking about.
2:16:51
So, again, on average, this is an issue.
Hassan Naveed
2:15:31
And this speaks at a time when we're looking at complaints at a record high.
2:15:35
We've seen just in the last year itself 12,000 complaints.
2:15:39
This is the highest since 2012 that have been filed against officers that have been, I guess, alleged misconduct.
2:16:55
Yeah.
2:16:55
And and, again, discipline resides within the discretion of the police commissioner.
2:16:59
And how the police commissioner is carrying out really leads it to to that decision making process.
2:17:04
I can't speak to what goes into the commissioner's mind themselves in that decision making process.
2:17:09
What we can say is that there is a situation where we're saying that it's my recommendations have only in this particular case, 30% of the time compared to previous commissioners.
2:17:21
I'd also add that CCRB did testify not too long ago on the matter of it being granted of it itself advocating for display of powers to be given to the agency itself, sort of recognizing the fact that this is a matter of concern.
2:17:40
Inconsistency.
2:17:40
When we have this lack of balance, I guess, unenforcement that is.
