10 min

Council Member Yeger raises objections regarding the lack of a proposed agenda published 36 hours prior to the meeting, as stipulated by Section 42 of the charter.

Despite Yeger's motions to sideline today's agenda items and reconvene later, the presiding officer rejects the motions, leading to the initiation of a roll call vote on Yeger's objections.

Speaker 1
0:28:02
And I'd like to call on my colleague, council member, common Jaeger.
Speaker 4
0:28:09
Thank you.
0:28:10
We're still here.
0:28:12
Sorry about that.
0:28:14
Not going to reiterate the entire key of what I said earlier.
0:28:18
And obviously, as I recognize and I have a clock me.
0:28:21
I'm not gonna make a motion, but I just do want to note for the record as I've discussed earlier at the previous stated.
0:28:27
Section 42 of the charter requires that at least 36 hours prior to a meeting of the council, the council has to publish and make publicly available a proposed agenda for a meeting.
0:28:37
It's not a notice that a meeting is gonna happen that's actually proposed agenda.
0:28:41
We do it all the time.
0:28:42
It looks a little bit like this.
0:28:43
We get it in our inboxes in this occasion, and in for the previous stated, we did not receive that.
0:28:49
It's different from the email that was sent at at 4:50 PM on Friday.
0:28:53
That was a notice that a meeting is happening.
0:28:55
That's the same notice that goes to the press.
0:28:57
Anybody else who signs up for our list That's different from a proposed agenda.
0:29:01
In this case, that agenda did not occur.
0:29:05
It was not sent out.
0:29:06
I don't know if it was prepared or not.
0:29:08
But it was not here.
0:29:11
The the rules of the council don't supersede the charter's provision, the charter itself has this language, and it's there for a reason.
0:29:19
And so that the council doesn't do things like this, set up meetings, not tell the world, even though we knew what was going to be on the agenda, but that's we have rules for a reason.
0:29:27
One of the rules we have is that there's a proposed agenda.
0:29:31
Let the world know what it is we're going to be doing in a formalized way.
0:29:35
And that was not done.
0:29:36
And for that reason, I do move that the matters on today's agenda be later side.
0:29:42
And that a notice be properly made to the members of counsel and to the public, and that we reconvene at such a later time as the speaker determines when the speaker reconvenes the meeting.
0:29:53
Thank you very much.
0:29:55
Oh, in addition, since I have the floor and why not let's not do this again to the extent that my motion is denied as I expected will be.
0:30:05
I move to separate the questions on the General Motors calendar into couple them.
0:30:09
Thank you.
Speaker 1
0:30:20
Counseling over here, can you please state your point of order and the amendments you're making?
Speaker 4
0:30:25
Thank you, ma'am.
0:30:26
The point of order is that as a matter of order, we are required to have an agenda, a proposed agenda, published, or made publicly available, that's the words of the charter, a proposed agenda for the meeting.
0:30:40
This is a stated meeting, it's not a special meeting, and that was not done at this meeting, that was not done at the prior meeting.
0:30:46
And I know that the discussions on the day is earlier focused around the question of whether or not an email sent out at approximately 4:15, Friday constituted an agenda.
0:30:56
But that's not an agenda.
0:30:57
That's simply a meeting notices.
0:30:59
Just let everybody know, you know, lock off some time on your schedule, Tuesday, come on down to city hall.
0:31:03
We're gonna have some fun.
0:31:05
That's not what an agenda is an agenda.
0:31:07
As we have always done it, looks like this.
0:31:09
It shows up on your inbox.
0:31:11
It shows up typically a day or 2 before stated.
0:31:14
For this stated and for the one held earlier this morning, such a document did not arrive.
0:31:18
The only document that arrived is Can
Speaker 1
0:31:21
you pause for a minute?
Speaker 4
0:31:22
Sure thing.
0:31:23
Thank you, man.
0:32:27
Manor President, I can provide additional clarity if it seems to be unclear.
0:32:30
I see this.
Speaker 1
0:32:31
Not needed.
0:32:31
Please hold.
0:32:32
Okay.
0:33:07
Thank you.
0:33:10
Your motion is not well sorry.
0:33:14
Point of order.
0:33:16
Your motion is not well taken.
0:33:18
The charter requires that a proposed agenda be posted.
0:33:21
A proposed agenda was posted on Friday, as mentioned prior.
0:33:25
There's no requirement that a proposed agenda contain all items to be considered.
0:33:31
We will I'm sorry.
0:33:33
Further, section 42 of the charter, provides that such proposed agenda be published as soon as practical.
0:33:41
Your point of order again is not well taken.
0:33:44
What motions do you propose?
Speaker 4
0:33:47
Well, I I rose for a point of order.
0:33:49
The point of order was for the items on the agenda.
0:33:51
It wasn't a motion.
0:33:51
The point of order was for the items on the agenda to be stricken as they were not properly noticed.
0:33:55
In a proposed agenda, and there was no proposed agenda for this meeting posted.
0:34:00
There was simply a notice that a meeting was happening.
0:34:02
In other words, They didn't even have that there would be an indication or that there would be a roll call or an adoption of minutes.
0:34:09
It didn't have any of the things that we typically have I know this may sound esoteric to those who are not familiar with counsel process, but those who are
Speaker 1
0:34:16
Counsel member leader, you are conflating a point of order right now.
0:34:20
We Yes.
0:34:22
We need to know what the motion on the floor is.
Speaker 4
0:34:25
It's not it's not a motion.
0:34:26
I'm rising for a point of order.
0:34:28
Regarding the order of the
Speaker 1
0:34:30
Client point of order is not well taken.
Speaker 4
0:34:32
Okay.
0:34:32
Very good.
Speaker 1
0:34:33
Do you have a motion?
Speaker 4
0:34:34
My motion is that the items on today's agenda be stricken from the calendar as the calendar is not properly done in accordance with the charter of the city of New York and thus we should not be meeting until such time as an agenda or a proposed agenda is sent out 36 hours prior to the meeting.
Speaker 1
0:34:53
That is not a valid motion.
Speaker 4
0:34:56
So I man and president, it's not a valid motion to propose that matters that are on the agenda to be stricken from the calendar.
0:35:16
Sorry.
0:35:16
Let me use the words later side.
Speaker 2
0:35:20
Hearing will allow us to move forward.
Speaker 1
0:36:03
There's a motion on the floor to lead the items on the agenda on the table.
0:36:30
There's a motion to lay the items on the agenda on the table.
0:36:33
Clerk, can you call a roll call vote?
0:37:53
Okay, folks.
0:37:56
There was a motion on the floor from House member Jaeger to lay the items on the table, and a vote is to lay the items aside.
0:38:04
A no vote is to proceed with the general order calendar.
0:38:10
We can now call for a roll call vote.
