Comments on proposed legislation related to surveillance technology oversight

Commissioner Strauber provides DOI's perspective on three proposed bills related to surveillance technology oversight: Intro 168, Intro 233, and Intro 480. These bills align with recommendations made in DOI's 2022 POST Act report.
- DOI is generally supportive of all three bills
- The proposed legislation tracks with 11 recommendations from DOI's 2022 report
- Nine of these recommendations were initially rejected by NYPD
- Two recommendations have since been accepted or accepted in principle by NYPD
- DOI appreciates the Council's support for their oversight mission and specific recommendations

With respect to the proposed legislation, DOI has reviewed introductions 168, two 30 three, and four eighty are being considered at today's hearing.

These are bills that were first heard in December of twenty twenty three and that DOI testified about at that time.

We continue to be generally supportive of all three bills, which track 11 of our recommendations made in our first twenty twenty two post act report.

One recommendation that NYPD issue a unique IUP for each distinct surveillance technology was initially rejected but was later accepted after DOI issued the recommendation in our 2023 report.

Another recommendation that NYPD provide DOI with an itemized list of all surveillance technologies that the department is using was initially rejected but has now been accepted in principle.
