Council Member Gale Brewer questioned Deputy Commissioner Michael Gerber about NYPD's data practices, drone usage, and compliance with open data requirements. The discussion covered the department's policies on selling data, updates to drone Impact and Use Policies (IUPs), and the need to properly share data on the Open Data Portal.
- NYPD confirmed they do not sell data to commercial entities
- The department acknowledged deficiencies in their drone IUP and plans to revise it based on DOI recommendations
- Brewer emphasized the importance of sharing required data on the Open Data Portal, which NYPD agreed to address

Back to the data issue.
2:11:45
So I think council member Gutierrez asked if the police department buys data, and you said no correctly.
2:11:50
So my question is do you sell data or do you have agreements with vendors that allow any use of data for other purposes?
Michael Gerber
2:11:58
Certainly, not not to my knowledge.
2:11:59
Selling data, you mean like to to third parties?
2:12:02
I'm certainly aware of no such thing.
2:12:06
Our vendor agreements, like I said, have standard language that would flat out prohibit that.
2:12:10
They can't do that.
2:12:12
Again, we share with other law enforcement agencies.
2:12:17
That's a very different matter.
2:12:19
But if you're talking about selling our data to to to commercial entities, no.
Gale Brewer
2:12:26
Okay.
2:12:26
That's helpful.
2:12:27
Second, on the drone, back to the drones a little bit.
2:12:29
So you have a lot more drones, which makes sense, more capacities.
2:12:34
Has the police department updated its unmanned aircraft systems, IUP, to reflect the changes of the numbers and how they're going about their business?
Michael Gerber
2:12:44
Yeah.
2:12:44
So so I know exactly what you're getting at, which is the the latest DOI report in December pointed out a number of deficiencies in our drone IUP.
Jennifer Gutiérrez
2:12:54
Right.
Michael Gerber
2:12:55
I think I'm not I'm not sure if I agree with a % of what they said, but I I think a lot of it is totally fair.
2:13:00
Totally fair.
2:13:01
And we haven't given our formal response yet.
2:13:05
But I can just tell you now that we are going to be accepting most, if not all, of those recommendations.
2:13:13
And we're gonna be revising the drone IUP in light of of that report.
2:13:19
Because I think I think they make some very, very fair points about our need to update that IUP to reflect various steps that we've taken.
Gale Brewer
2:13:28
Okay.
2:13:28
That's helpful.
2:13:29
And then just finally back to my data portal.
2:13:33
So drone data is quarterly reported on the website, as you know, but it's not in the open data portal.
2:13:39
Don't forget this is twenty year discussion with Gail Brewer because even though it's on your information portal, it's not on the open data, and it is supposed to.
2:13:48
I think there are about 1,400 deployments in the fourth quarter of last year, and so that would have been an example of going on the open data portal.
2:13:57
So will you make sure that the data that is supposed to go on the open data go on the open data portal?
Michael Gerber
2:14:05
I get it.
2:14:06
I'm I'm I'm not familiar with the open data portal.
2:14:08
That's that's on me.
2:14:09
Certainly to certainly to the extent what was that?
2:14:13
I'm sorry.
2:14:13
I know.
2:14:14
Know.
2:14:14
I understand.
2:14:15
I understand.
Gale Brewer
2:14:16
I spent five years getting the data from PD onto the Open Data Portal, and this go ahead.
Michael Gerber
2:14:22
No.
2:14:22
Understood.
2:14:23
Chair, to to the extent we have data that we are publicly sharing, but we are required to put on the Open Data Portal and we have not been doing that properly, we will get that fixed.
Gale Brewer
2:14:32
Thank you.
2:14:32
Thank you very much.
2:14:33
I'm done.
