Council Member Yusef Salaam inquires about the NYPD's practices in sharing collected data with other law enforcement agencies such as ICE or the FBI. Deputy Commissioner Michael Gerber explains the department's approach to data sharing.

  • NYPD shares information with other law enforcement organizations for criminal investigations
  • The department participates in federal task forces, which involve sharing data and information
  • In joint investigations, information is shared freely between partnering agencies
  • Gerber emphasizes that NYPD does not engage in civil immigration enforcement or share surveillance technology for such purposes

Does the NYPD share collected data with other law enforcement agencies such as ICE or the FBI?
1:05:12
If so, under what guidelines?
1:05:14
Right.
Michael Gerber
1:05:15
So we we do share information with other law enforcement organizations in connection with criminal investigations.
1:05:22
Right?
1:05:23
And we, as you know, are a part of numerous federal task forces, criminal task forces investigating criminal activity.
1:05:33
And as part of that, there is sharing of data and information in connection with those criminal investigations.
1:05:39
And I should say when we think about a joint criminal investigation, say working with the FBI or working with the DEA, right, we don't think about sharing in that context broken down by surveillance technology.
1:05:51
If we're doing a case jointly, a criminal case jointly with the FBI, the expectation is that our detectives and the FBI agents are going to share information freely between them as part of that joint investigation.
1:06:06
We expect the FBI to share with us.
1:06:08
The FBI expects us to share with them.
1:06:10
And that's really the whole task force model, right, of bringing together different law enforcement partners and agencies working collaboratively on criminal investigations.
1:06:23
I also want to say you mentioned ICE.
1:06:25
To be very, very clear, as you know, we do not engage in civil immigration enforcement, and we do not share surveillance technology in furtherance of civil immigration enforcement.
