Council Member Yusef Salaam inquires about the storage and access of video and data collected by NYPD drones. Deputy Commissioner Michael Gerber explains the department's policies.
- The standard storage period for drone footage is 30 days
- Footage related to criminal cases is saved for discovery purposes and becomes part of the case file
- Other reasons for extended storage include FOIA requests and other disclosure obligations
- Gerber clarifies that unless there's a specific reason for longer retention, drone footage is only kept for 30 days

Just following along with that, with the drones in terms of where's the video and data from NYPD drones stored and who has access to it?
Michael Gerber
1:10:27
Right.
1:10:27
So the short answer to that is the storage period is thirty days.
1:10:31
Right?
1:10:32
Thirty days unless it's related to a criminal case.
1:10:35
So, right.
1:10:37
So if there's footage on a drone that relates to a criminal matter, to a criminal case, that will obviously be saved for discovery purposes and becomes part of the criminal case file essentially as a practical matter.
1:10:51
Right?
1:10:51
I mentioned this before.
1:10:52
So if it's part of a criminal case, it's going go as part of that criminal case, and obviously that has to be stored and critical that it be stored for discovery purposes.
1:11:00
Otherwise, the storage period for our drones is thirty days.
1:11:04
I should add, by the way, there are other reasons why video could be retained.
1:11:07
Right?
1:11:07
So if there's a FOIA request and we have other disclosure obligations, just to be clear on that.
1:11:13
But unless there's some other reason why the video is gonna be saved, it's it's it would otherwise only be saved for thirty days.
