So right now it's only so you're saying the bill that's being discussed in Albany is just for the unfounded cases?
Jess Dannhauser
1:36:48
So there's a few things that, as I understand it, that DOI is looking at.
1:36:53
One is around access in our juvenile detention facilities.
1:36:57
There's some important considerations around the privacy of young people.
1:37:01
But we provide a plethora of information.
1:37:06
Everything that happens DOI receives.
1:37:11
Under the current law, they need OCFS approval for us to hand over certain things.
1:37:17
We've been in conversations very regularly with the OCFS commissioner and the DOI commissioner about that process and we've seen OCFS make a lot of adjustments in that process to make sure DOI has everything it needs to do its job.
1:37:31
That is my commitment.
1:37:33
On the child welfare side, as I understand it, key thing is that DOI would be able to get because they get everything else now.
1:37:41
They get active cases that are active when there's a critical incident And they get all of the indicated history.
1:37:49
My perspective on this is that we have to just make sure that family information on unfounded, they should be able to know whether we did our job.
1:38:00
But family information should be protected.
1:38:02
So I think like the juvenile justice side, I think there should be some consideration of a role for OCFS.
1:38:08
It shouldn't be ACS's role to decide what goes there and what doesn't.
1:38:12
That is DOI's job to investigate and to make sure that we're doing doing work and there's no malfeasance in this work.
1:38:20
And so this conversation about the best way to balance privacy for families and give them what they need is one that we're actively engaged in.
