Council Member Aviles inquires about the Department of Corrections' (DOC) interpretation of detainer laws and MOIA's involvement in ensuring compliance. MOIA representatives explain their monitoring process and assert that DOC has not violated any detainer or sanctuary city laws.

  • MOIA receives monthly reports from DOC on detainer-related activities
  • MOIA closely monitors these reports for compliance
  • MOIA is scheduling meetings with DOC, DOP, and NYPD regarding guidance on sanctuary laws

Thank you, council member nurse.
1:04:55
In terms of, has the Department of Corrections reached out to Moya for guidance and interpretation on the detainer laws?
1:05:05
I know we you mentioned definitely touch points.
1:05:08
Have you had specifically had conversations and offered guidance to DOC?
UNKNOWN
1:05:16
Sorry.
Rebecca Engel
1:05:16
No.
1:05:16
I have not.
Alexa Aviles
1:05:18
So we understand that, Department of Corrections has their own interpretation of the law.
1:05:24
What has Moya done to ensure that they are not following an interpretation that does not actually uphold the law?
Rebecca Engel
1:05:33
So DOC actually reports to us on a monthly basis everything that is required under local law 228.
1:05:40
And so it is an extensive report that talks about, you know, how many detainers and who was who was actually held and for what reason.
1:05:49
And I follow that report very closely and then, of course, report on it.
1:05:52
And they have not in my in my, time here, have ever violated any of our our detainer laws and or our Insaneur City laws.
