Council Member Rita Joseph inquired about compensatory services for students who missed services during remote learning. Liz Vladeck, the DOE's General Counsel, responded:
- The issue of compensatory services is currently being litigated
- Due to ongoing discovery, they are unable to provide specific numbers or details
- Vladeck offered to discuss broader initiatives about getting students with disabilities back into classrooms and providing intervention services
- She emphasized that the DOE led the country in quickly returning students with disabilities to in-person services
The DOE was unable to provide specific data on how many students had IEP-recommended compensatory services for remote learning during the 2022-2023 school year due to the ongoing legal proceedings.

And so even if I was more inclined, our council has advised us we've got to stay away from those numbers at this point.

However, if you are open to it, I personally, am always very impressed to hear about our broad initiatives, what we did, and how we led in the country in terms of getting students with disabilities back into classrooms with their services faster than anyone else and engaged in the kind of intervention services that allowed us to make sure students' IEPs reflected where they were at at that moment, whether or not the need was specifically named a comp service need.
