Obviously, in this climate, there's a ton of concern regarding the vulnerability that so many of our constituents are in specific specifically with regards to to ICE.
1:31:02
And so I think a lot of the concerns that folks in my district have and so many throughout the city is the ease at which very important information, data that PD has at their disposal, the ease at which it can get transferred to an agency like ICE.
1:31:16
I'm aware just from you answering my previous questions that, you know, with permission federal agencies, any agency, of course, through the right process can can get their hands on this important information, on important data.
1:31:31
Can you all what can you tell me today?
1:31:35
I know things are changing regarding the ease at which ICE can have access to this important data that in the past we were assured was not possible.
1:31:45
Has that changed today?
Michael Gerber
1:31:46
No.
1:31:46
That that has not changed.
1:31:47
Let me be very, very clear about this.
1:31:49
And the police commissioner has been crystal clear about this.
1:31:53
We do not participate in civil immigration enforcement.
1:31:57
But they We do not.
Jennifer Gutiérrez
1:31:58
The data that another agency, for example, attains from PD, that can be shared with ICE.
Michael Gerber
1:32:06
So we share information in connection with criminal investigations.
1:32:10
If your question is, is it possible that a federal agency then or a a a participant in the task force then uses that or shares that in connection with civil immigration enforcement, that is possible.
1:32:22
Yes.
1:32:23
It is possible.
1:32:25
We do not do that, period.
1:32:27
I do want to emphasize that what I'm describing is consistent with the law and is actually addressed in the city law.
1:32:36
Right?
1:32:36
Because if you look at the admin code ten one seventy eight, it has an express carve out for the task forces, right?
1:32:44
It speaks to this situation that we are allowed to and we do work with the task forces as part of task forces on a wide variety of very important criminal investigations.
1:32:56
It's incredibly important work for the safety of of the city and for fighting crime.
1:33:02
We will not and do not provide information in furtherance.
1:33:08
We do not provide surveillance technology information, period, in furtherance of civil immigration enforcement.
1:33:13
No exceptions to that.
1:33:14
What federal agencies then do in terms of their communications and sharing, I can't speak to that.
